Terms of Service

1. Agreement

These Terms are an agreement between you and Zestworks for the use of the Wayfold apps and website. The app asks you to accept these Terms and our Privacy Policy before you use it, and again when they change materially; tapping Agree is your acceptance, and we record the version and date. If you do not agree, do not use Wayfold.

2. The service

Wayfold lets you plan itineraries, import bookings, keep packing lists, record and split expenses, save ideas, write a travelogue, and share trips with companions you invite. We may change, add or remove features at any time.

3. Eligibility and accounts

You must be at least 13 years old, or older where your local law requires, to use Wayfold. You are responsible for your account, for keeping your sign-in secure, and for everything done with it.

4. Travel information is not official advice

Visa and entry requirements, passport validity rules, emergency phone numbers, local customs, phrases and translations, weather forecasts and exchange rates are provided for convenience only. They may be incomplete, out of date or wrong, and rules can change without notice.

Always confirm entry requirements with the destination's embassy or official government sources and your carrier before you travel. In an emergency, rely on local authorities. Booking details read from screenshots may be misread; check them against your booking. Wayfold is not a travel agent, does not make bookings, and is not responsible for travel decisions you make.

5. Your content

You own the content you add. You give us a limited licence to store, process and display it only to provide Wayfold to you and the members of the trips you share it with.

When you add content to a shared trip, its members can see it, and it may stay in that trip after you leave or delete your account (see the Privacy Policy). Only invite people you trust.

6. Acceptable use

You agree not to:

• Break the law or infringe anyone's rights through Wayfold.
• Post content that is abusive, harassing, hateful or sexually explicit, or that threatens anyone.
• Interfere with, overload or attempt to gain unauthorised access to Wayfold or other users' data.
• Reverse-engineer the app or use it to build a competing service, except where the law permits.

We may remove content or suspend accounts that break these rules. To report abuse, email us.

7. Expenses and settle-ups

Balances, splits and settle-up suggestions are calculated from what members enter. Wayfold does not move money, and is not responsible for payments between members or for mistakes in the amounts entered. Currency conversions are approximate.

8. Wayfold Pro

Wayfold is free to use. The free plan lets each account create up to three trips per calendar year, counted by the year a trip starts (a trip that starts in the past counts toward the current year, and one more than a year ahead toward the next). Trips you are invited to do not count. Deleting a trip before its start date frees its place; deleting it later does not.

Wayfold Pro is an optional subscription that removes the yearly trip limit and adds extra themes. Reaching the limit never locks or deletes anything you have created; it only stops you creating another trip that year. Visa information, document expiry, emergency numbers and reminders are free whatever plan you are on.

Subscriptions are bought through the Apple App Store or Google Play, and billed by them at the price shown before you confirm. They renew automatically for the same period until you cancel, which you can do at any time in your App Store or Google Play account settings; cancel at least 24 hours before the current period ends to avoid being charged for the next one. Refunds are handled by Apple or Google under their policies.

We may change Pro's features or price. A price change applies from your next renewal, after notice through the store.

9. Third-party services

Wayfold works with services such as maps apps, Apple Pay and the Shortcuts app, Google and Apple sign-in, and weather providers. Your use of them is governed by their own terms, and we are not responsible for them.

10. App stores

If you download Wayfold from the Apple App Store or Google Play, these Terms are between you and Zestworks, not Apple or Google, which have no responsibility for the app or its support. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.

11. Ending your use

You can stop using Wayfold and delete your account at any time. We may suspend or end your access if you break these Terms or if we stop offering the service.

12. Disclaimer of warranties

To the fullest extent permitted by law, Wayfold is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not guarantee that Wayfold will be uninterrupted, error-free or that data will never be lost.

13. Limitation of liability

To the fullest extent permitted by law, Zestworks is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data, travel costs, missed flights or denied entry, arising from your use of Wayfold. Our total liability for any claim is limited to the greater of the amount you paid us in the past 12 months or USD 50. Some jurisdictions do not allow these limits, so they may not apply to you.

14. Indemnity

You agree to indemnify Zestworks against claims arising from your content or your breach of these Terms, to the extent permitted by law.

15. Governing law

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules, except where the law of your country of residence gives you protections that cannot be waived. Courts in California have jurisdiction over disputes, subject to those protections.

16. Changes

We may update these Terms. We will update the effective date and tell you in the app about material changes; continuing to use Wayfold afterwards means you accept them.
